Will having a durable power of attorney prevent the need for a conservatorship?

Having a durable power of attorney is important in order to prevent the court assigning a guardian or conservator to your property. So long as the attorney in fact named in a durable power of attorney remains available and able to make decisions, the court should not act on your behalf.
